HIGHLANDS SPORTS CENTRE & GRACIE BARRA MITTAGONG
MEMBERSHIP TERMS & CONDITIONS
Our membership terms are designed to provide clear and consistent guidelines around membership continuity, temporary holds, billing, cancellation, participation, and member responsibilities.

1. MEMBERSHIP & BILLING
-
Membership is an ongoing recurring service and continues until cancelled in accordance with these Terms & Conditions.
-
Membership fees are charged according to the membership selected at enrolment.
-
Members are responsible for ensuring their payment details remain current and valid.
-
Highlands Sports Centre (HSC) may update membership fees or terms with reasonable notice. Any specific price protection offered by HSC will be honoured according to the conditions of that offer.

2. MEMBERSHIP SETUP FEE
-
A $99 Membership Setup Fee applies when commencing a new membership unless HSC confirms a promotion, discount, or waiver.
-
The fee covers member registration, account and program setup, onboarding, and development-system setup where applicable.
-
If a membership is cancelled and the member later returns, the current membership rate and applicable Membership Setup Fee will apply.
-
An approved Membership Hold keeps the membership active and does not trigger a new Membership Setup Fee when normal membership resumes.

MEMBERSHIP HOLDS
Our Standard Hold Allowance
-
Up to 12 weeks per calendar year
-
Minimum 2 consecutive weeks per hold
-
$9.50 per week maintenance fee
3. WHAT IS A MEMBERSHIP HOLD?
A Membership Hold is intended for a genuine temporary absence, such as travel or an extended period away, where the member intends to return to training on a nominated date.
A Membership Hold is not intended to switch membership payments on and off based on weekly attendance, busy periods, missed classes, or short-term absences.
Every hold must have a confirmed start date and return date. Open-ended holds are not available.
4. MEMBERSHIP HOLD LIMITS
Each individual membership may use:
-
Up to 12 weeks of voluntary Membership Hold per calendar year
-
Each hold must be for a minimum of 2 consecutive weeks
-
After returning from a voluntary hold, the membership must remain active and on normal billing for at least 4 consecutive weeks before another voluntary hold can begin
Unused hold weeks or hold periods do not carry forward into the following calendar year.
Hold allowances apply separately to each individual membership within a family.

5. HOLD FEES & HOW HOLDS WORK
-
A $9.50 per week membership maintenance fee applies from the first week of every approved voluntary hold.
-
Normal membership billing automatically resumes on the nominated return date.
-
Members cannot attend classes while their membership is on hold.
-
If a member wishes to return earlier than the nominated return date, HSC must be notified and normal membership billing will resume from reactivation.
-
An approved hold protects the member's existing membership status and current rate, subject to any conditions attached to that rate.
-
Hold requests should be submitted before the planned absence. HSC is not required to backdate a hold.
MEDICAL & EXCEPTIONAL CIRCUMSTANCES
6. MEDICAL OR EXCEPTIONAL HOLDS
Medical, injury-related, and genuine exceptional circumstances may be considered outside the standard voluntary hold rules at HSC management's discretion.
Depending on the circumstances, HSC may approve:
-
A longer hold period
-
A waiver or variation of the maintenance fee
-
A waiver or variation of the 4-week active period between holds
Exceptions are considered individually and do not create an automatic entitlement to an extended, unlimited, or fee-free hold.
HSC may reasonably request supporting information when considering an extended exception.

CANCELLATION
7. CANCELLING YOUR MEMBERSHIP
-
Membership cancellation requires 4 weeks' written notice.
-
Normal membership fees remain payable during the notice period, and members may continue attending eligible classes.
-
A request to stop membership payments indefinitely without a confirmed return date will be treated as a cancellation, rather than a Membership Hold.
-
Once a membership is cancelled, any protected or historical membership rate ends unless HSC confirms otherwise in writing.
-
If a member returns in the future, current membership pricing and the applicable $99 Membership Setup Fee will apply.

ATTENDANCE & TIMETABLE
8. ATTENDANCE, HOLIDAYS & TIMETABLE CHANGES
-
Membership provides access to eligible classes included in the selected membership, subject to timetable, capacity, age group, program rules, and coach direction.
-
Membership is based on access to the selected program rather than a guaranteed number of classes actually attended.
-
Ordinary missed classes, short absences, and school holiday periods do not automatically pause membership.
-
HSC may make reasonable changes to timetables, coaching arrangements, programs, or class structures as the centre develops.

PAYMENTS & MEMBERSHIP CHANGES
9. FAILED PAYMENTS & MEMBERSHIP CHANGES
-
Any outstanding membership fees remain payable.
-
HSC may contact the account holder and reattempt failed payments in accordance with the arrangements of its payment provider.
-
HSC may temporarily restrict attendance where an account remains overdue after reasonable attempts have been made to resolve the outstanding balance.
-
Requests to change membership level should be made to HSC administration and will take effect from the date confirmed by HSC.

PARTICIPATION, SAFETY & CONSENT
10. PARTICIPATION & INHERENT RISKS
Wrestling, Brazilian Jiu-Jitsu, grappling, fitness, movement activities, games and related physical training involve physical activity and, in some programs, physical contact. Participants may be exposed to inherent risks including falls, collisions, strains, sprains, muscle soreness and other injuries.
By participating in activities at HSC, members and parents/guardians acknowledge these inherent risks and agree to take reasonable care during training.

11. SAFETY & COACH INSTRUCTIONS
Members and parents/guardians agree that participants will:
-
Follow reasonable instructions provided by coaches and HSC staff
-
Follow applicable safety rules and equipment requirements
-
Use equipment appropriately
-
Inform a coach if they are unwell, injured or unable to safely participate
HSC and its coaches may modify, restrict or stop a participant's involvement in an activity where they reasonably consider this necessary for the participant's safety or the safety of others.

12. MEDICAL INFORMATION & EMERGENCIES
Members and parents/guardians are responsible for providing HSC with relevant information about medical conditions, injuries, allergies, medications, disabilities or other circumstances that may affect safe participation.
HSC should be informed of any relevant changes as soon as reasonably possible.
In an emergency, the participant or their parent/guardian authorises HSC staff to provide reasonable first aid and, where considered necessary, seek emergency medical assistance.
The participant or their parent/guardian remains responsible for any external medical, ambulance, hospital or transport costs that may arise, where applicable.
Nothing in these Terms & Conditions is intended to exclude, restrict or modify any rights or protections that cannot lawfully be excluded, restricted or modified.

13. MEDIA CONSENT
HSC may take photographs or video during classes, events and activities for legitimate centre purposes.
Media consent for promotional use is optional and is provided separately during registration or through the HSC's designated consent process.
Where a participant or parent/guardian has selected that they do not consent to promotional use, HSC will take reasonable steps to respect that preference.
Media consent may be withdrawn by contacting HSC in writing. Withdrawal will apply to future promotional use but may not be reasonably possible for material that has already been published or distributed.
ADMINISTRATION
14. MEMBERSHIP ADMINISTRATION
-
Hold, cancellation, and membership-change requests must be submitted through the designated HSC process or in writing.
-
The date HSC receives a valid request will be used for administration purposes unless another date is confirmed in writing.
-
HSC maintains membership records including membership status, hold periods, hold weeks used, return dates, approved exceptions, and cancellation dates.
-
Members and parents/guardians are responsible for ensuring the information provided to HSC remains accurate and up to date.
